He has also led sensitive internal investigations to successful\, private resolutions. \nBradford and his team have provided legal support to some of the most innovative deposits\, lending\, card\, payments\, and fintech infrastructure projects in recent years. He has handled appeals across a wide swath of matters—ranging from antitrust to bankruptcy law to class-action certification to constitutional law to federal preemption to the enforcement of arbitration agreements—but has particular expertise in federal regulation and administrative law. He has handled cases addressing rules and other agency actions from\, among other agencies\, the CFPB\, DOL\, FCC\, FERC\, FDA\, FMCSA\, IRS\, NHTSA\, NPS\, and STB. \nBefore joining DWT\, David served as deputy general counsel at the FCC where he oversaw all of the Commission’s litigation. We’ll also address recent litigation against the Consumers Financial Protection Bureau (CFPB) late fee rule and the recent District Court decision ruling the Corporate Transparency Act unconstitutional. \nGuest speakers include: Fred Burnside and Chris Walczyszyn (Davis Wright Tremaine LLP). \n\nThere is no fee to participate. This complimentary webinar is open to NASCUS members as part of our ongoing series of special L&R Calls addressing key issues in the credit union system. \nRegistration is required. Burnside\nFred Burnside concentrates his complex civil litigation practice on matters related to class-action defense\, consumer financial services\, and commercial litigation. His more than two decades as an attorney is distinguished by significant victories in state and federal trial and appellate courts\, particularly in actions challenging banking fees and services. \nSince successfully defending a pioneer class action lawsuit over insufficient funds (NSF) fee practices\, Fred has represented dozens of major financial service providers facing similar claims. He also has the rare experience of taking a financial services class action through a jury trial—and winning. With an established track record of securing outright victory or favorable settlements\, Fred has become the go-to attorney for consumer financial service providers facing class action lawsuits challenging fees charged by banks and credit unions. \nHis leadership at DWT includes serving as the co-chair of the Class Action Defense group and co-chair of the Consumer Financial Services Litigation industry team\, and he previously served as the firm’s Deputy Chair of the Litigation Department\, Executive Committee member\, and on the firm’s Share (Compensation) Committee. He is a co-chair of the ABA’s Annual National Institute on Class Actions\, editor of the ABA Class Action Committee’s Annual Survey of State Class Action Litigation\, and a member of the American Law Institute. \n\n\n\n\n\n\nChris Walczyszyn\n\n\n\n\n\n\n\n\nChris Walczyszyn advises banks\, fintechs\, and other financial industry clients on regulatory and enforcement matters related to state and federal consumer financial laws. Chris focuses his practice on responding to regulatory examinations and defending government enforcement actions. He has experience representing various financial institutions before the Consumer Financial Protection Bureau (CFPB)\, the U.S. Department of Justice\, the Federal Reserve Board\, and other federal and state regulators. \nChris also counsels clients in the lending\, payments\, e-commerce\, and consumer financial spheres on compliance with a range of laws including ECOA\, TILA\, EFTA\, GLBA\, FCRA\, ESIGN\, and laws prohibiting unfair\, deceptive\, or abusive acts or practices.
