SUMMARY:NASCUS Webinar Series: Third-party Vendors
DESCRIPTION:NASCUS Webinar Series\nCredit Unions v. Vendors: Winning the Legal Battle Over Risk and Liability\nJoin Us on March 10\, 2025 from 3:00 pm – 4:00 pm\nNASCUS is pleased to present the next installment in our complimentary webinar series exclusively tailored for attorneys. \nThird-party vendors present some of the most significant risks to credit unions—yet their contracts often provide limited recourse when issues arise. \nThis session goes beyond standard vendor management guidance to deliver powerful legal strategies for reclaiming control. Attendees will uncover hidden contract pitfalls that quietly shift risk\, learn how to challenge restrictive terms like liability caps and explore underutilized legal avenues—including fraud\, gross negligence\, and trade secret misappropriation claims—to hold vendors accountable beyond the contract. \nWhether assessing vendor agreements or advising on risk mitigation\, this webinar will equip attorneys with the critical insights to identify hidden risks and deploy effective legal strategies. \nAttendance is free as a NASCUS member benefit. Registration is required.\nA virtual meeting link will be sent out ahead of the webinar.

SUMMARY:NASCUS Webinar Series: Emerging Class Action Litigation Trends Involving Financial Institutions
DESCRIPTION:NASCUS Webinar Series\nEmerging Class Action Litigation Trends Involving Financial Institutions: Reg E\, Meta Pixels\, and More\nJoin Us on June 11\, 2025\, from 3:00 pm – 4:15 pm (ET)\nNASCUS is pleased to present the latest offering in our ongoing series of complimentary member webinars surveying the state of class action litigation in the financial services sector. \n\nWe will be joined by David Wright Tremaine’s Fred Burnside to provide an overview of the current trends in class action litigation against financial institutions and suggested mitigation steps financial institutions should consider. \nDuring this interactive and informative webinar\, Fred Burnside will provide an overview of the latest developments in Regulation E litigation involving overdraft disputes\, peer-to-peer payment legal vulnerabilities\, liabilities arising from the use of website traffic monitoring tools\, and more. \nRegistration is required. There is no cost for attending as a NASCUS member benefit. \n\nSpeaker\n\nFred Burnside concentrates his complex civil litigation practice on matters related to class-action defense\, consumer financial services\, and hydroelectric relicensing. His more than two decades as an attorney is distinguished by significant victories secured on behalf of financial service providers\, at trial and on appeal in state and federal courts\, particularly in class action lawsuits regarding non-sufficient funds (NSF) fees. \nFred obtained a motion to dismiss in the pioneer class action lawsuit over NSF fee practices and has since successfully defended other major financial services providers facing similar claims. He also has the rare experience of taking a financial services class action through a jury trial—and winning. With an established track record of securing outright victory or favourable settlement\, Fred has become the go-to NSF fee attorney for consumer financial service providers facing class action lawsuits. \nHis leadership at DWT includes serving as the co-chair of the class action defense group\, and he previously served as the firm’s deputy litigation department practice group chair\, Executive Committee member\, and on the firm’s Share (Compensation) Committee. He is a co-chair of the ABA’s Annual National Institute on Class Actions\, editor of the ABA Class Action Committee’s Annual Survey of State Class Action Litigation\, and a member of the American Law Institute.
